*1575PECKHAM, Senior District Judge:
Appellant brought suit under Title III of the Omnibus Crime Control and Safe Streets Act of 1968, 18 U.S.C. §§ 2510 et seq. for the alleged unauthorized interception of oral communications. The district court, 706 F.Supp. 1467, granted summary judgment in favor of appellees, finding that appellant had failed to present evidence sufficient to make out a prima facie case.1 Because we believe that a question of material fact remained for trial in this ease, we reverse.
