On November 2,1995, Mary Virginia Pearson Oberkor filed a complaint against Central Alabama Home Health Care Services, Inc. (“Home Health”), in the Circuit Court of Tallapoosa County. Oberkor’s complaint averred that she had been injured on September 28, 1993, while working in the line and scope of her employment, and it sought payment of workers’ compensation disability benefits and medical expenses pursuant to the Alabama Workers’ Compensation Act (“the Act”).
