This is an appeal from an interlocutory order overruling a plea of privilege, which, being filed by appellants herein, and controverted by appropriate affidavits of appellee, was tried on its merits. The action was brought by Gus Genitempo against W. W. Boyd, state game, fish, and oyster commissioner, A. C. Thompson, his deputy, and G. B. Gunn, and others, sureties on his official bond. All the defendants reside in Wise- county, except Thompson, who resides in San Patricio county, and who entered his appearance without claiming his venue privilege.
