CALDWELL, District Judge.

Pending is Plaintiffs motion for preliminary and permanent injunctive relief. This matter arises under the Federal Power Act, 16 U.S.C. § 791a, et séq. (“FPA”) and, so, we properly exercise jurisdiction according to 28 U.S.C. § 1331.

I. Facts

Plaintiff is the Federal Energy Regulatory Commission (“the Commission”), a federal agency charged, inter alia, with enforcing the FPA. Defendants are the owners of the Blackstone Mill (“Blackstone”), a small hydroelectric generating facility on the Mahantango Creek in Dauphin County, Pennsylvania.1 Blackstone produces…
