This cause is here on appeal, and a motion is made for judgment on the pleadings, consisting of the amended petition and the answer. It is based upon Section 11601, General Code of Ohio, which provides that, when a party is entitled by law to judgment in his favor upon the statements and the allegations of the pleadings, judgment should be so rendered by the court, notwithstanding the verdict has been found against such party.
