This case was heard upon the pleadings, stipulations and depositions before the new equity rules went into effect. I have been greatly assisted in the consideration of the important and difficult questions involved by the thorough briefs of counsel upon both sides and by the oral arguments made upon the hearing, to all of which I have given careful consideration.
