In this case, Plaintiff United States of America (the “Federal Government”) as well as the Vulcan Society, Inc. (the “Vulcan Society” or the “Vulcans”), Marcus Haywood, Candido Núñez and Roger Gregg (the “Individual Plaintiffs”) have brought suit to challenge the use by the City of New York of two written examinations in the screening and selection of applicants for entry-level firefighter positions in the Fire Department of New York (“FDNY”).1 The court has bifurcated the liability and relief phases of the case (see Docket Entry # 47),…
