This is a suit brought by the appellee, John J. Simonich, in the circuit court of Will county, under the Federal Employers’ Liability Act, against the appellant, Chicago & Alton Railroad Company, for personal injuries which he claims he suffered while in the employ of the appellant. The appellee was employed in the company’s yard at Joliet as a freight handler. On the day of the injury, the appellant had received a freight car loaded with 63 bales of cotton, which had been shipped from Little Rock, Arkansas; there were -22 bales…
