The defendant Baker gave to Estelle B. Crawford, plaintiff’s testatrix, an instrument under seal dated December 10, 1923, and acknowledged on December fourteenth following, according to which the defendant agreed to save Mrs. Crawford harmless against loss on account of a certain bond and mortgage held by her, and the foreclosure thereof, and against the claim of another. All of the provisions of the contract had for their end this primary object of saving Mrs. Crawford harmless.
