Joseph Ruppert, as a trustee of the Fairmount Park, Inc. Retirement Savings Plan (“the Plan”), brought this action against Principal Life Insurance Company (“Principal”), alleging violations of the Employee Retirement Income Security Act (“ERISA”), 29 U.S.C. § 1001 et seq. The district court 1 denied Ruppert’s request for class certification, and the case proceeded on an individual basis.
