This appeal arose out of a divorce action instituted by plaintiff in error, hereinafter referred to as “plaintiff”, against Gibson Palmer (who died after the briefs were filed herein, resulting in revivor in the name of the defendant in error), hereinafter referred to by his trial court designation of “defendant”.
