Irene D. Chastain brings this appeal from the District Court of Oklahoma County. The appellee, James N. Posey, acting as the executor of the estate of J.T. Chastain, deceased, also filed a cross petition in error in this action arising from a divorce proceeding. Irene Chastain’s appeal revolves around the effect of the death of the husband after judgment but before a motion for new trial had been ruled upon, where neither party had assigned as error the granting of a divorce in their motions for new trial.
