POLLOCK, District Judge.

- Erwin R. Bergdoll, petitioner, confined in the disciplinary barracks, Ft. Leavenworth, this district, under sentence and judgment of a general court-martial for a term of four years, files and presents his petition for writ of habeas corpus to obtain his release from such confinement. To this petition the commandant of the prison has filed his response, which has been duly traversed. On issue so joined evidence dehors the record of the court-martial proceeding has been taken, filed, and ordered made a part of the record of this case, and the matter now stands fully…
