This case arose when appellee Hendrix, resident manager and agent for Morris Heights Apartments, swore out a dispossessory warrant against appellant tenant, Denise Smith. Appellant filed her answer and moved for summary judgment, which was denied. The merits of the case were tried before a jury, which returned a verdict in favor of appellee.
