This case came before the court below on a certiorari from a justice’s court in relation to the distribution of money raised by the sale of the property of one Pressly. The money was claimed by Wilson under a distress warrant for rent, which was levied on the 18th of June, 1874. Thornton also claimed the money under an attachment which was levied on Pressly’s property on the 29th of June, 1874, and also on a lien in the nature of a mortgage, executed by Pressly to him, to indemnify him as security, dated 5th of May, 1874, but which had not been foreclosed.
