INCH, District Judge.
Plaintiff brings suit to obtain a decree forbidding tbe defendant from using tbe name “United Drug.” Defendant has duly answered. ’ Jurisdiction is based upon tbe diversity of citizenship of tbe parties, and same has been duly proved.
Tbe plaintiff is a Massachusetts corporation, resident in said state. Tbe defendant is a resident of tbe state of Hew York. Tbe complaint alleges unfair competition on tbe¡ part of tbe defendant by bis use of tbe said name “United Drug Exchange.” Ho money damages are sought.
