OPINION

MURRAY, Justice.

The State of Rhode Island indicted the defendant, Gerald Brown, with four counts of sexual assault and child molestation. Count 1 charged the defendant with violating G.L.1956 (1981 Reenactment) §§ 11-37-8.1 and 11-37-8.2, as'amended by P.L.1984, ch. 59, § 2, by digitally penetrating his daughter, Karen, 1 a person under the age of thirteen. Count 2 charged the defendant with violating the same statutory provisions by engaging in vaginal intercourse with his daughter, Karen.
