This is the second time this workers' compensation case has come before this court on appeal. On the prior appeal, Tallassee Super Foods v.Hepburn, 771 So.2d 477 (Ala.Civ.App. 2000) (hereinafter "Hepburn I"), Jean Hepburn had sued her employer, Tallassee Super Foods, for workers' compensation benefits for pain in her right foot, which she had claimed was work related. The trial court entered a judgment finding Hepburn to be totally-permanently disabled. On appeal, this court reversed the original judgment and remanded the case because the trial court had used an incorrect standard of review.…
