ORDER REGARDING DEFENDANT’S MOTION TO DISMISS

SINGAL, District Judge.

Before the Court is Defendant’s Motion to Dismiss pursuant to Fed.R.Civ.P. 12(b)(6) (Docket # 8). Alleging that Defendant sexually molested her while she was a child, Plaintiff asserts claims against Defendant under 42 U.S.C. § 1983, as well as Maine state law claims for assault, intentional infliction of emotional distress, negligent infliction of emotional distress and punitive damages.
