Defendant, Gregory Escobar, was convicted of murder (HI. Rev. Stat. 1983, ch. 38, pars. 9 — l(aXl), (aX2)) following a jury trial in the circuit court of Cook County. The trial judge sentenced defendant to the penitentiary for a term of 40 years.

Defendant now appeals, contending: (1) double jeopardy principles bar his being retried after a first trial ended in a mistrial, (2) the evidence adduced at his second trial was insufficient to prove him guilty beyond a reasonable doubt of murder, (3) the trial judge erred in denying his motion in limine to preclude any reference at trial to polygraph…
