On or about March 27th, 1933, the defendant 1016 Fifth Avenue Company, Incorporated, obtained a judgment against the complainant, Charles P. Norcross, in the supreme court of the State of New York for moneys due it on account of rent of an apartment occupied by him and his wife, Gladys C. Norcross. The complainant, on or about September 11th, 1933, filed a petition in bankruptcy, and, consequently, was adjudicated a bankrupt. In the schedules attached to his petition, he listed no assets.
