Reversing.

Oscar Pierson and Raymond Stinnett were jointly indicted for the murder of Earl Baumbach. On his sepa rate trial Pierson was found guilty and. Ms punishment fixed at death. He appeals.

As -.to the following facts there is practically no dispute: The police department of the city of Louisville had received information that a Ford coupe belonging* to M. D.
