Appeal by tlie defendant, the Metropolitan Street Railway Company, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 15th day of December, 1902, upon the verdict of a jury- for $1,500, and also from an order entered in said clerk’s office on the 8th day of December, 1902, denying the defendant’s motion for a new trial made upon the minutes.

This is an action to recover damages for personal injuries alleged to have been sustained by the plaintiff through the negligence of the defendant. Between eight and nine o’clock in the evening on the 20th day of November, 1901, a south-bound car of the defendant on Second avenue collided with a vehicle passing westerly on Thirty-second street across the track upon which plaintiff was riding, precipitating him to the street, and inflicting the injuries of which he complains.
