Appeal by the defendant, the Third Avenue Railroad Company, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 29th day of January, 1903, upon the verdict of a jury for $12,000, and also from an order entered in said' clerk’s office on the 4th day of February, 1903, denying the defendant’s motion for a new trial made upon the minutes.

Lagghlin, J. :

This is an action to recover damages for personal injuries sustained by the plaintiff, an infant of the age of six years three months and fourteen days, through the alleged negligence of the defendant. On the 23d day of August, 1895, the plaintiff, while crossing Amsterdam avenue from east to west either along the southerly crosswalk line of One Hundred and Fifty-eighth street or a short distance northerly of the northerly crosswalk line of that street, was struck and injured by one of the defendant’s northbound cable cars on Amsterdam avenue.
