1Opinion of the CourtMikoll, J.

Appeal from an order of the Supreme Court (McDermott, J.), entered November 1, 1990 in Albany County, which denied defendants’ motion for summary judgment dismissing the complaint.

The response is in the negative. The order denying defendants’ motion for summary judgment dismissing the complaint should therefore be reversed.
