THIS MATTER is before the Court on the parties’ cross motions for summary judgment and Plaintiffs motion to strike Defendant’s amended answer to the first amended complaint.

I. FACTUAL AND PROCEDURAL HISTORY

Defendant Harrah’s North Carolina Casino Company, LLC (“Defendant” or “Harrah’s”) entered into a Management Agreement with The Eastern Band of Cherokee Indians in June 1996 to manage the Tribe’s casino operation in Cherokee, North Carolina.
