This is the second appearance here of this case. The former opinion is found in 248 Fed. 679, 160 C. C. A. 579, where a very complete statement of the facts as presented in that trial appears. To that we refer for a history of the transactions involved. As we proceed with this opinion there will be pointed out some ’of the differences in the records of the two trials..
