This suit was brought by J. T. Glaze, the appellant, against Milbank Johnson, the appellee, to recover a parcel of land situated in the city of Houston. The form of the action was trespass to try title, and the service was by publication. On this service judgment was rendered for plaintiff at the August term, 1900, of the District Court, appellee being represented by counsel appointed by the court in accordance with the requirements of the statute.
