THOMPSON, District Judge.

This case is submitted to the court on demurrer to the petition. The demurrer alleges that the petition *38does not state facts sufficient to constitute a cause of action. The points made in argument in support of the demurrer are: (1) The petition does not show that the plaintiff, Louis Loeb, is the original holder of the bonds sued on, and if he be an assignee or. subsequent holder thereof he is not entitled to maintain this action because the bonds are payable to bearer, and were not made by a corporation.
