Appeal from a judgment of the County Court of Columbia County (Lea-man, J.), rendered May 1, 1995, upon a verdict convicting defendant of the crime of possession of fighting animals.
On August 12, 1994, Victor Bailly and Mark McDonald, special agents for the American Society for the Prevention of Cruelty to Animals (hereinafter the ASPCA), accompanied by informant Juan Molina and 10 live roosters, pursued an undercover investigation of defendant, who was suspected of unlawfully housing fighting animals in Columbia County in violation of Agriculture and Markets Law § 351 (3) (b).
