The plaintiff in error, T. C. Maurer, was the plaintiff in the lower court in an action for damages against the city of Norfolk and two contractors, J. U. Addenbrook’s Sons, Inc. and F. J. McGuire, who were engaged in doing work upon the streets of Norfolk for the city. The plaintiff claimed that he had suffered personal injuries in crossing one of the streets under repair by the contractors, by reason of the negligence of the defendants in failing to use reasonable care to keep the street in a safe condition.
