The facts necessary to a determination of the questions involved in this case may be briefly stated as follows: The plaintiff in error, American Surety Companv, commenced a suit in the district court of Muskogee county, Okla., against Charles Chapman, and ancillary thereto, issued a garnishment summons to the defendant in error, John A. Wolsey. A motion - to quash the garnishment summons was filed by John A. Wolsey, and a hearing was had thereon before the Honorable W. X Crump, district judge.
