— Action by respondent, plaintiff below, to recover the statutory penalty for the alleged negligent killing of her husband;. Samuel Williams. Plaintiff recovered judgment for $10,000 and defendant appealed. .

Plaintiff’s husband was injured, by a collision between an automobile which he was driving and a street car owned and operated by-defendant. The collision, occurred in St. Louis County where the street ear track crosses Marshall Avenue in said county. Marshall Avenue runs north and south and the street car tracks run east and west.
