Hubbs, J.:

On October 31, 1920, James E. Yates was killed in the transmission tower of the defendant the Niagara Falls Power Company. His death was caused by a short circuit in a high-power transmission line. He left him surviving his wife, Georgia A. Yates, his sole statutory beneficiary. (See Code Civ. Proc. § 1902 et seq.; now Decedent Estate Law, § 130 et seq., as added by Laws of 1920, chap. 919.) She was appointed administratrix of his estate and brought this action to recover damages against the defendants for negligently causing the death of her husband. She died pending the trial and…
