Laverty, Inc. appeals from a summary judgment entered by the United States District Court for the Southern District of Iowa dismissing its action for damages against Mel Jarvis Construction Co., Inc. 1 Laverty sought recovery for the destruction' and damage by fire of a large quantity of its corn stored in a grain bin under construction by the defendant contractor. The gist of the action was that defendant’s negligence caused the fire.
