Creditor Marion Pierson has filed an objection to Debtor Gerald B. Miller’s claim of a homestead exemption. The Chapter 7 Trustee supports the objection. The Debtors strenuously oppose it.

The facts that give rise to this objection are not in dispute. In January, 1982, Pier-son commenced a negligence action against Gerald B. Miller in the Superior Court of the Commonwealth of Massachusetts for injuries Pierson sustained in an automobile accident caused by Miller.
