Plaintiff seeks to have the title to the real estate hereinafter described adjudged to be in defendant Casady, and to subject said real estate to execution on a judgment in its favor against said defendant. The facts necessary to a consideration of the controversy are, in the main, undisputed. May 1, 1924, plaintiff recovered judgment against defendant Casady in the sum of $13,395.54.
