This comes before us on plaintiff’s motion for a new trial after the jury *2found a verdict for defendant in an action for libel based upon an article appearing in a newspaper owned and published by defendant.

On June 4, 1947, the fifth edition of the Evening News, published by defendant in Harrisburg, stated that plaintiff had been convicted by a jury in Dauphin County court on charges of receiving stolon goods.
