The defendant, Rahiem Wyatt, challenges a determination of the Supreme Court, Kings County, designating him a risk level two sex offender pursuant to Correction Law article 6-C, the Sex Offender Registration Act (hereinafter SORA), upon the Supreme Court’s denial of his application for a downward departure to risk level one. We conclude that the Supreme Court properly, in effect, denied the defendant’s application, and we affirm the risk level designation.
