The plaintiff is a Chinese, and the defendant is the Tax Collector for the city and county of San Francisco. The suit is brought to recover the amount of a tax paid by the former to the latter, and the question presented is the constitutionality of an act of the Legislature of this State, approved April 26th, 1862. The act is entitled “ An Act to protect free white labor against competition with Chinese coolie labor, and discourage the immigration of the Chinese into the State of California.” It levies a monthly tax of two dollars and fifty cents “ on each person, male and female, of the…
