MEMORANDUM OPINION AND ORDER

WEINER, District Judge.

Plaintiff, Foremost Insurance Company, brought this action seeking a declaratory judgment against Joan B. Lynch, Adminis-tratrix of the estate of her deceased husband, William E. Lynch. Presently before the court are the parties’ cross motions for summary judgment based upon a stipulation of facts. For the reasons which follow, we grant the motion of Foremost and deny the motion of Lynch.
