MEMORANDUM OPINION

ROBERT E. PAYNE, Senior District Judge.

This matter is before the Court on the Defendant’s Motion to Dismiss (Docket No. 15). For the reasons that follow, the motion will be denied.

BACKGROUND

On March 1, 2009, the Defendant, Eluterrio S. Brown, Jr., who had no home save for his car, pulled into the parking lot of a fast food restaurant. Shortly thereafter, Richmond police officers came up to Brown’s vehicle to speak with him about a defective taillight.
