To a fair understanding of this matter, the general fact situation must be reviewed.

One Allie M. Robinson was the holder of some interest in the 80 acres of land involved herein. A judgment was obtained against her and her husband, and on execution thereunder, said land was sold on May 28, 1921, and went to deed in June, 1922, plaintiff, Alvin A. Clark, being the purchaser at sheriff’s sale. Allie M. Robinson died in April, 1922, and E. H. Elbert was appointed and qualified as administrator of her estate.
