About October 5, 1929, the plaintiff-appellant caused to be served upon the defendant-appellee an original notice, summoning the latter to appear in the Linn County district court, which commenced November 4th of that year. The purpose of such appearance was to answer the appellant’s petition in equity, wherein it sought to recover: First, judgment against the appellee in the sum of $366.90, together with interest and costs; and second, the foreclosure of a conditional sale contract covering certain personal property.
