MORRIS, District Judge.

The defendant herein is a railroad company engaged in interstate commerce. The plaintiff at the time of the injury, to wit, on the 1st day of November, 1906, was an employe of the defendant, engaged in repairing its railroad track on which such commerce is carried on. The complaint rests upon two claims of negligence: The negligence of the defendant, and the negligence of its employes who were at the time of the accident the fellow servants of the plaintiff. The only ground on which the demurrer was seriously pressed was that the complaint does not state facts…
