Appeal from an order of the Supreme Court (McNamara, J.), *656entered May 29, 2001 in Albany County, which denied defendant’s motion for summary judgment dismissing the complaint.
Plaintiff brought this negligence action to recover for an injury she sustained in the entryway of defendant’s apartment building at around 11:00 p.m. on February 17, 1997. According to plaintiff, while descending the stairs from the second floor, she slipped and fell as she stepped off the final step.
