This is the appeal by Kenneth Hardesty (Hardesty) of his lawsuit against Prime- Lending, a PlainsCapital Company (Prime-Lending), and CitiMortgage, Inc. (Citi-Mortgage), for declaratory relief and fraud in connection with the foreclosure of a $500,000.00 home equity loan secured by real property owned by his mother, Carolyn C. Hardesty, deceased.
