Tbe Owensboro Sbovel & Tool' Company is a manufacturing corporation engaged in business in Owensboro, Kentucky. It owned certain timber rights in Ballard County. George Moore owned a saw mill. At tbe instance of 0. P. Moore, an employe of tbe Owensboro Sbovel & Tool Company, George Moore moved bis saw mill to a point upon or near tbe land upon wbicb tbe timber owned by tbe Tool Company stood and, under a verbal agreement with C.
