1Opinion of the CourtSpratley, J.
On June 2, 1959, the trial court, after hearing the evidence in open court, neither party demanding a jury, rendered a judgment in favor of Sam Finley, Incorporated, against W. B. Meredith, trading as W. B. Meredith Construction Company, and Henry G. Luhring, Jr., in the sum of $9, 963.00, with interest and costs. Motions to set aside, vacate or modify the judgment, as being contrary to the law and the evidence were overruled on June 2 and 16, 1959. On July 31, 1959, Henry G. Luhring, Jr., filed notice of appeal and assignments of error. Rule of Court 5:1, § 4.
