1Opinion of the CourtEggleston, J.
Joseph G-. Lewis was indicted at the October, 1950, term of the court below for the armed robbery of Mrs. Marguerite D. Lee. Code, § 18-163. Upon arraignment he pleaded not guilty and was tried at the January, 1951, term by a jury which found him guilty as charged and fixed his punishment at confinement in the State penitentiary for nine years. Judgment entered upon the verdict was stayed during the term upon the motion of the accused to set aside the verdict and award a new trial.
